Privacy policy

This is a courtesy translation. Only the German version is legally binding: Datenschutzerklärung.

Protecting your personal data matters to us – all the more so as a dental practice. This privacy policy explains which personal data is processed when you visit our website, for what purpose, and what rights you have.

Our website itself does not set any cookies, and we do not use any analytics, tracking or advertising services. The only exception can arise if you choose to load the Google map (see section 8).

This policy covers our website. We will inform you separately at the practice about how your data is processed in connection with your dental treatment.

1. Controller

The controller responsible for data processing on this website is:

Zahnärzte am Gärtnerplatz 1
Jens-Uwe Buchholz
Gärtnerplatz 1
80469 München
Germany

Phone: +49 (0) 89 2013349
Email: kontakt@zahnaerzte-gaertnerplatz.de

2. Hosting

Our website is hosted by STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. The servers are located in Germany. When you visit our website, the data required for this is processed on STRATO's servers.

We have concluded a data processing agreement with STRATO in accordance with Art. 28 GDPR. STRATO therefore processes the data only on our instructions and in compliance with the GDPR.

The legal basis is our legitimate interest in providing our website securely and reliably (Art. 6(1)(f) GDPR).

3. Server log files

Each time our website is accessed, the server automatically records information transmitted by your browser. This includes:

  • the IP address of the requesting device
  • the date and time of access
  • the page or file requested
  • the website from which you reached us (referrer)
  • the browser and operating system used

This data is technically necessary to display the website and to ensure its stability and security, for example to fend off attacks. It is not combined with other data and is deleted automatically after a short period, unless it is needed to investigate a security incident. The legal basis is Art. 6(1)(f) GDPR.

4. Encryption

For security reasons, our website uses SSL/TLS encryption. You can recognise an encrypted connection by the padlock symbol and by “https://” in your browser’s address bar.

5. Fonts

The fonts used on this website are stored on our own server. No connection is made to third-party servers, such as Google Fonts, when the pages load.

6. Contacting us by email or telephone

If you contact us by email or telephone, we process the details you give us – such as your name, contact details and your enquiry – in order to answer your enquiry and, where appropriate, to arrange an appointment.

The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to, or prepares for, a treatment; otherwise our legitimate interest in responding to enquiries (Art. 6(1)(f) GDPR). Where you share health information with us, we process it on the basis of Art. 9(2)(h) GDPR in conjunction with Section 22(1)(1)(b) of the German Federal Data Protection Act (BDSG), and subject to medical confidentiality.

Please note that ordinary email is not end-to-end encrypted. Where possible, we would therefore ask you to share sensitive health information by telephone or in person at the practice.

We keep your details only for as long as is necessary to deal with your enquiry or as required by statutory retention periods.

7. Online booking via Doctolib

For online appointment booking, we link to the Doctolib platform. Doctolib is not embedded in our website: only when you click on a booking link are you taken to Doctolib’s website. The provider is Doctolib GmbH, Friedrichstraße 111, 10117 Berlin, Germany.

The processing of your data during booking is governed by Doctolib’s privacy notice: doctolib.legal/privacy-policy-B2C-DE.

8. Google Maps

On our homepage and on our “Directions” page, you can choose to display a map from Google Maps. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The map is not loaded automatically. Only when you click “Load map” is a connection made to Google’s servers. In particular, your IP address and information about your browser are then transmitted to Google, and Google may also set cookies. A transfer to the USA is possible. Google LLC is certified under the EU-US Data Privacy Framework, on the basis of which the European Commission has recognised an adequate level of data protection.

The legal basis is your consent, which you give by clicking “Load map” (Art. 6(1)(a) GDPR and Section 25(1) of the German Telecommunications Digital Services Data Protection Act, TDDDG). It applies only to the page you are viewing at the time. If you do not load the map, no data is transmitted to Google.

Further information can be found in Google’s privacy policy: policies.google.com/privacy.

9. Links to other websites

Our website contains links to other providers, for example review sites (Google, Jameda, werkenntdenBESTEN) and route planners (Google Maps, Apple Maps). Simply visiting our website does not transmit any data to these providers. Only when you click on a link are you taken to the provider’s website, and that provider is then responsible for any data processing there.

10. Your rights

You have the following rights with regard to your personal data:

  • Access to the data we process about you (Art. 15 GDPR)
  • Rectification of inaccurate data (Art. 16 GDPR)
  • Erasure of your data, unless statutory retention obligations apply (Art. 17 GDPR)
  • Restriction of processing (Art. 18 GDPR)
  • Data portability (Art. 20 GDPR)
  • Objection to processing based on our legitimate interest (Art. 21 GDPR)
  • Withdrawal of any consent you have given, with effect for the future (Art. 7(3) GDPR)

To exercise these rights, please simply contact us using the details given under “Controller” above.

11. Right to lodge a complaint

If you believe that the processing of your data infringes the GDPR, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is:

Bayerisches Landesamt für Datenschutzaufsicht (BayLDA – Bavarian Data Protection Authority)
Postfach 1349
91504 Ansbach
Germany
